Canner, Inc. (“Canner” or the “Company”) is committed to help protect the privacy of individuals (“Visitors”) who visit Canner’s web sites (“Sites”) and individuals and companies (“Customers”) that register to use or purchase our software or services (collectively “Products”). This Privacy Policy (the “Policy”) describes Canner’s commitment to protect your information and, specifically, explains Canner’s privacy practices in relation to the use of Sites and the data collection and use practices for the information and/or reports that will be sent to, or collected by, Canner as a result of your use of the Products. Further, we respect your privacy and we are committed to protecting your personal data in line with the General Data Protection Regulation – Regulation (EU) 2016/679 (GDPR). This Policy will inform you as to how we will look after your personal data when you interact with us, including visiting our Sites or using our Products. It also tells you about your rights in relation to your personal data.

What Is Personal Data And Who Is Responsible For Looking After My Personal Data?

Personal data is any information about an identifiable individual. Canner is responsible for personal data which we collect from you and, along with our distributors, resellers, dealers and other sales channels, we are also responsible for how we handle personal data which we collect from Canner’s sales partners.

How Long Will We Keep Your Personal Data For?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Collection and Use of Information for Visitors to Canner’s Sites

Canner may collect certain information from visitors to the Sites as described below. Canner uses information it collects for various purposes, which may include registration of its customers, authentication, fulfillment of your requests for products and Products, to collect payment, and to communicate with you regarding Canner Products.

Collection and Use of Information for Customers of Canner

When you use the Products, basic information about how you use the Products, which may include compliance with use limitations, is collected and sent to Canner on a periodic basis. In addition to ensuring compliance with license restrictions, this information will help us improve the features our customers use most often and to create solutions to common problems. Information that Canner may gather includes, but is not limited to, the following: API calls, web traffic, page views, source and target IP addresses, amount of data moved, bandwidth usage, storage usage. Canner may gather additional information, and you can always check this Policy, as may be updated from time to time, in order to determine what information is currently gathered by Canner.

Registration Data

At your election (opt-in), you may desire to register for a web event sponsored by Canner or subscribe or gain access to various information resources concerning Canner’s products, services, user groups and business. If you do so, our registration process may require you to provide your first and last names, company name, address, telephone number, email address and certain additional information (such as, for example, your preferred contact method, and products or markets that may be of interest to you), which is referred to as “Registration Data.” Canner uses Registration Data to contact you when necessary, to respond to your inquiries for additional information, to verify your registration for closed events, to provide additional information according to your preferences and for Canner’s other business purposes. Sometimes Registration Data is used to send you information about Canner and its products, services and business partners. At your election at any time (opt-out), you may choose to stop receiving future communications from Canner (see below). Lawful Grounds For Using Your Personal Data

There are various lawful grounds on which we use your personal data including the following legitimate interests:

  1. understanding how our customers use our Products;
  2. keeping our records up to date;
  3. to develop and support our Products and to grow our business;
  4. to inform our marketing strategy including to define customers for our Products.

In addition, standard computer information contained in the reports typically includes certain information about your computer software and hardware, such as your IP address, operating system version, web browser version, your hardware ID (which indicates the device manufacturer, device name, and version), and your regional and language settings.

This information may be sent to Canner when you are connected to the Internet and will identify you based on the information you submit when you are using the Products. Canner may use the information to improve its software and identify trends and usage patterns.

Surveys and Responsive Requests; Social Media

If you have opted to participate, from time to time, we may request information from users via surveys or similar responsive requests. Participation in these surveys or responsive requests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name, email and shipping address), and demographic information (such as zip code, age level). If you give us personal information about somebody else, such as a spouse or work colleague, we will assume that you have their permission to do so. Survey information may be used to monitor or improve the use and satisfaction of the Sites or our products and Products.

Our Sites may also use social media features, such as the Facebook ‘like’ button. These features may collect your IP address and which page you are visiting and may set a cookie to enable the feature to function properly. You may be given the option to post information about your activities on our Sites to a profile page of yours that is provided by a third party social media network in order to share with others within your network. Social media features are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing the relevant social media features.

Public Forums

We may provide bulletin boards, blogs, or chat rooms on our Sites. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. We are not responsible for the personal information you choose to submit in these forums.

Restrictions on Disclosure of Your Information to Third Parties

Canner will not disclose your personal information or information regarding your use of our Sites or Products to any third party without your prior consent except to affiliates and service providers solely for the purpose of providing the Products to you or in connection with the transfer of our business or assets to which the information relates (collectively “Third Parties”). We will require all Third Parties to abide by confidentiality obligations in order to protect your information. In addition, we require that Third Parties provide robust protection of your information no less protective than as set out in this Policy. Moreover, we may disclose your information as lawfully requested by governmental, judicial or public authorities, including to meet national security or law enforcement requirements, to comply with applicable laws and regulations, and pursuant to legal and equitable actions concerning the Products, this Policy or the Terms of Use. If we are involved in a merger, acquisition or asset sale, such information may be shared with the acquiring entity or successor-in-interest, but we will continue to ensure the confidentiality of any personal data pursuant to the terms of this Policy.

Information that is collected by or sent to Canner will be stored and processed in the United States and Tokyo Region. By using the Products, you consent to the transfer, storage, use, and disclosure of information gathered, as described in this Policy, in the United States, subject to the requirement that transfer, storage, use and disclosure of the information complies with protections at least as robust as those contained in this Policy.

International Transfers

We are an entity which is based in the United States of America, and we may utilize service providers that are based outside of the European Economic Area (EEA). This means that your personal data may be transferred outside of the EEA. Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

Canner is committed to protecting the security of the information we collect from you. We use a variety of industry standard security technologies and procedures to help protect the Sites and Products and your information from unauthorized access, use, or disclosure. Your Choices – Your Right To Opt Out, Access, Change or Delete Your Personal Information

You have the opportunity to opt-out of any disclosures by Canner of your personal information in accordance with this Policy. Our opt-out procedure is simple and straightforward. In order to opt-out, please contact us by email or mail as per the For "More Information section" below and inform us that you are electing to opt out of any and all disclosures of your personal information by Canner. We will promptly honor and confirm your request by email or mail. You also have the right to know what personal information about you is included in our databases and to ensure that such information is accurate and relevant for the purposes for which Canner collected it. You may access, edit or delete your personal information by contacting Canner by mail or email as per the For More Information section below. In making modifications to your personal information in Canner’s possession, you must provide only truthful, complete, and accurate information. Canner will endeavor to respond in a timely manner to all reasonable written or email requests to view, modify, or delete your personal information, but in no event will our initial response take longer than thirty (30) days. We reserve the right to verify the identity of anyone requesting access to personal information pursuant to this Policy. We may also contact you to ask you for further information in relation to your request to speed up our response. No Fee Usually Required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Your Right To Make A Complaint And How To Contact Us

Your privacy is very important to us. You have the right to make a complaint at any time to the supervisory authority for data protection issues in your country. Changes to this Statement

Canner may occasionally update this Policy. When we do, we will also revise the date in the footer of the privacy statement to indicate when last updated. We will make our employees aware of changes to this Policy either by posting to our intranet, through email, or other means. We will notify you of material changes in the Policy through our publicly posted website. We encourage you to periodically review this Policy to stay informed about how we are helping to protect the information we collect, and we will always allow you to choose whether your personal information should be deleted, removed, altered or used in a different manner.

Acceptance of Privacy Policy

By using the Sites and the Products, you consent to the collection, use and storage of your information by us in the manner described in this Policy. We reserve the right to make changes to this Policy at any time. If we decide to change our Policy, we will post those changes on our Sites or through our Products so our users are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

If you do not agree with this Policy, please do not use the Sites or the Products. Your continued use of the Sites and/or Products following posting of changes to these terms will mean you accept those changes.

Children’s Privacy

The Children’s Online Privacy Protection Act restricts the collection and use of personal data pertaining to children under the age of 13. We do not allow such children to register as users and will not knowingly collect or solicit personal data from anyone under the age of 13. No one under the age of 13 should provide any personal data on or through the Sites or otherwise. In the event we learn that we have collected personal data from a child under age 13, we will terminate the any account and communications, and delete such information. Minors aged 13 and over should not use this site or post any information or other content without adult supervision.
